Limited Warranty
TuffDock Systems, LLC ("TuffDock") warrants to the original purchaser/homeowner that TuffDock Piling™ will be free from manufacturing defects—including peeling, flaking or blistering, any defect that could allow the piling to be consumed by marine borers.If such a defect appears within twenty (20) years from the date of purchase, TuffDock will, at its option, supply replacement product (but not the labor cost, freight, taxes or other expenses associated with de-installation and re-installation), or repair the product, or adjust the product, or refund the original purchase price, prorated twenty years from the date of purchase, provided:
Buyer must notify TuffDock in writing within thirty (30) days after the appearance of the defect.
Buyer must send a brief written explanation of the defect, along with dated proof of purchase to TuffDock Systems LLC, P.O. Box 100, Germantown, OH 45327. TuffDock reserves the right to request additional information, including, but not limited to, photos and field inspections.
Failure, damage or malfunction resulting from normal wear and tear, improper handling and installation, misuse, abuse, negligence, alteration/modification, accident, excessive loads, incompatible chemicals, impact of foreign objects, tornado, hurricane, flood, fire, ice or any other acts of God are not considered defects under this warranty.
TuffDock does not warrant the design or the engineering of specific structures. Each purchaser is solely responsible for determining the effectiveness, suitability and safety for the use of any TuffDock product. TuffDock does not warrant any aspect of handling, transport or installation.
Any product not of TuffDock Systems own manufacture is sold under such warranty only as the maker thereof gives TuffDock and TuffDock is able to enforce, but such items are not warranted by TuffDock in any way.
This warranty may not be amended without the written and signed approval of an officer of TuffDock Systems LLC. No person or entity is authorized by TuffDock to make statements of representation regarding the performance of TuffDock Piling™ or any other TuffDock products, except as contained in this warranty. This warranty is not transferable.
THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PATICULAR PURPOSE.
TuffDock shall not be liable for any direct or indirect incidental, punitive, consequential, and exemplary or other damages of any kind whatsoever as related to TuffDock Piling™, or any other TuffDock products, whether such claim is based upon theories of contract, warranty, negligence, tort, strict liability or otherwise. This agreement shall be governed by and construed in accordance with the laws of the State of Ohio.
